MLSE AUCTIONS

Additional Terms and Conditions
  1. In the case of a conflict between the Ticketmaster Auction Terms and these Additional Terms and Conditions, these Additional Terms and Conditions will apply.

  2. Must be 19 years of age or older to submit a bid. Employees, shareholders and directors of Maple Leafs Sports & Entertainment Ltd. (“MLSE”), The Toronto Maple Leafs, the Toronto Raptors, the Toronto Marlies, Toronto FC, the National Hockey League and its Member Teams, NHL Enterprises Inc. the National Basketball Association, its Member Teams, NBA Properties, Inc., the American Hockey League and its member teams or Major League Soccer and its member teams (collectively, the “MLSE Parties”) and each of their respective affiliates and subsidiaries, immediate family members of the above, and anyone domiciled with any of the above are not eligible to bid and/or participate in the auction and any attempt to bid and/or participate in the auction will be null and void.

  3. By participating in this auction, each winning bidder grants to MLSE and, for auctions that include Raptors tickets, the National Basketball Association and NBA Properties, Inc., for auctions that include Leafs tickets the National Hockey League and NHL Enterprises Inc., for auctions that include Marlies tickets the American Hockey League, for auctions that include Toronto FC tickets Major League Soccer, the right to the use of his or her name, likeness or photograph, biographical information, city of residence and bid details without compensation in any publicity or for promotional purposes carried out by the above parties.

  4. By participating in this auction, each bidder agrees to hold harmless the MLSE Parties, and each of their respective parents, subsidiaries, affiliates, directors, officers, governors, employees, agents and advertising and promotional agencies (collectively, the "Released Parties") against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) entrant's participation in the auction, (ii) the receipt or use of the packages contained therein; and (iii) the administration of the auction and distribution of the packages purchased therein.

  5. Auction winners will be contacted directly by a representative of MLSE and will be directed as to how to claim the package elements. Packages must be accepted as described and cannot be exchanged for cash or otherwise. No telephone contact or correspondence will be entered into except with winning bidder. Packages are non-transferable by auction winner unless MLSE agrees in writing to a transfer request from auction winner, in which case, auction winner and transferee will be required to execute such transfer documents as are required by MLSE. Each package element must be enjoyed by the auction winner and, where more than one element of the auction package may be enjoyed by auction winner’s guest, the same guest must be chosen by auction winner for all elements. Winner’s guest must be 19 years of age or older on the date of the game to which the auction relates.

  6. If applicable, all Meet & Greet elements of the package will take place on game day at a specific time and place as pre-determined by MLSE. Meet & greet will not exceed 20 minutes. Player or personality subject to change.

  7. If game tickets form part of the auction package, the exact location of the seats will be determined by MLSE.

  8. If a team jersey forms part of the auction package, only one (1) jersey will be provided to the auction winner on game day.

  9. If a meal forms part of the auction package, the meal will take place on game day at a time specified by MLSE. Any meal charges over and above the allotted package amount will be the sole responsibility of the winning bidder who may be required to present a valid major credit card in his/her name to cover any overages. The allotted package amount is inclusive of taxes. Player or personality subject to change.

  10. If free arena/stadium parking forms part of the auction package, parking is provided for the auction winner’s vehicle only, for one (1) vehicle only, in a parking spot as specified by MLSE on game day only, and unless otherwise specified by MLSE, will be provided free of charge to auction winner from 30 minutes prior to game time until 30 minutes after conclusion of the game. Any additional parking charges will be the responsibility of the auction winner.

  11. If an on-ice, on-court or on-field experience forms part of the auction package, auction winner, and their guest, if applicable, will be required to sign limitation of liability documents as required by MLSE prior to participating in the experience. Failure to sign such documents as required by MLSE will result in auction winner’s forfeiture of the applicable element of the auction package with no reimbursement or compensation from MLSE or Ticketmaster.

  12. All incidental costs and expenses not specifically referred to as being part of the auction package, including (without limitation) transport to and from the Air Canada Centre, Ricoh Coliseum, BMO Field, as the case may be, food, beverages, souvenirs and items of a personal nature are not included and are the sole responsibility of the auction winner.

  13. Auction winners and their guests, will be required to sign such limitation of liability documents as deemed necessary by MLSE prior to participating in certain elements of the auction package. Failure to sign such documents as required by MLSE will result in auction winner’s forfeiture of the applicable element of the auction package with no reimbursement or compensation from MLSE or Ticketmaster.

  14. The auction is subject to all rules, regulations, policies, orders, by-laws and other rulings of the National Basketball Association (for auctions that include Raptors tickets), the National Hockey League (for auctions that include Leafs tickets), the American Hockey League (for auctions that include Marlies tickets) and Major League Soccer (for auctions that include Toronto FC tickets).

  15. In the event that the NHL, NBA, AHL or MLS game to which the auction relates is cancelled or postponed prior to commencement of the game and: (a) if the game is cancelled before bidding closes, the auction will be terminated, the auction package will be cancelled and all bids will be declared null and void; and (ii) if the game is cancelled after the bidding closes, the auction package will be cancelled and declared non-deliverable and if the winning bidder’s credit card has been charged in the amount of the winning bid, the winning bidder’s credit card will be credited with the full amount of the winning bid as originally charged to the winning bidder’s credit card. Auction bidders, including winner bidders, will not be entitled to any other compensation for game cancellation or postponement, except as specifically provided for in these Additional Terms and Conditions. A game that is played in part will not be considered to be a game that is cancelled and any game that is played in part will not be eligible for any refunds.
